Divorce Attorneys Near Me

If you live in Illinois and are contemplating divorce, then it is a good idea to find experienced divorce attorneys near you to guide you through the legal process.

What Are the Steps Necessary to File for Divorce?

The following steps may seem straightforward but, in many cases, especially those involving property and children, you are better off having a lawyer to help you navigate through the process of filing and obtaining a divorce.

The steps involved in filing and obtaining a divorce in Illinois are as follows:

  • Residency Requirements. You must meet the residency requirements for the state, which is the minimum period of 90 days.
  • Grounds for Divorce. You must have “grounds for divorce,” which means a legally sound and acceptable reason to terminate your marriage. Typically, a judge would need to find that there are “irreconcilable differences” which have caused a breakdown of your marriage. The judge would also need to conclude from the evidence that that efforts to reconcile have failed or that any further attempt to reconcile would not be possible at all.
  • Filing. You must file divorce papers and make sure copies are sent to your spouse. This must be done in a manner that satisfies the legal requirements to be deemed properly served or sent to your spouse. It may also be the case your spouse may avoid or try to make it difficult for you to show that you have complied with the law in serving him or her with the divorce papers. These are some of the things a lawyer can help you with.
  • Hearing. If your spouse does not wish to sign the divorce papers to allow your marriage to be dissolved or terminated, he or she will be required to file papers presenting their side of the story. When that happens, you have what is known as a “contested divorce,” which means you both must make your cases to a judge who will decide whether to grant the divorce or not.
  • Property. If you and your spouse have property that needs to be divided, or if you require financial support from your spouse, then you will have the option to discuss and agree with your spouse out-of-court regarding how you should divide the property. If you do not want to do that or do not agree, then how the property is divided will be determined by the judge in your case according to law.
