At the heart of our practice lies a deep commitment to serving those who have been wronged. We understand that facing a legal challenge can be one of the most stressful periods in a person’s life, which is why we are dedicated to navigating these tumultuous waters with you. SAM LAW OFFICE, LLC recently represented a mother in Mexico who had her daughter abducted by the father and illegally brought to the United States. We successfully argued the case under the Hague Convention on the Civil Aspects of International Child Abduction, and the Judge ordered the return of the child to Mexico. We understand the importance of working tirelessly to vigorously protect our client’s rights and fight for what they deserve in these difficult situations.
The Hague Convention is a treaty that establishes a process for the return of children who have been wrongfully retained or taken from one country to another. The treaty is designed to protect the rights of children and to prevent them from being used as pawns in international custody disputes. Our firm is proud to be a strong advocate for clients who are facing such international challenges, and we will do everything in our power to ensure that  the rights of the child and our clients are always put first.
In this case, the father had no legal right to take the child from Mexico. He had no court order granting him custody, and he did not seek the mother’s consent. His removal of the child from Mexico was, therefore, a wrongful abduction under the Hague Convention.
Our law firm worked closely with the mother to file a petition with the United States District Court seeking the return of her daughter. We argued that the child was a habitual resident in Mexico and that the father had wrongfully removed her from that country.
The father opposed the petition, but the Judge ultimately ruled in our favor. The Judge found that the child has habitually resided in Mexico and that the father had wrongfully removed her from that country. The Judge ordered the father to comply with the return of the child to Mexico, and the child was safely returned to her mother.
This case is an example of our firm’s success in representing parents in Hague Convention cases. We understand the significance of reuniting children with their parents, and we are committed to helping our clients achieve this goal. We are proud to have helped this mother reunite with her daughter, and we believe that the Hague Convention is an important tool for protecting the rights of children and preventing them from being used as pawns in international custody disputes.
