What To Do If You Are Involved In A Car Accident

Car accidents can happen to even the safest and most experienced of drivers. Crashes and collisions may be the result of road, traffic, and weather conditions, or they may be due to the reckless driving behaviors of other motorists. Unfortunately, even a seemingly minor fender bender can result in car accident injuries that are severe and potentially disabling. Knowing what to do in the event you are involved in an accident can help to protect the health and safety of your passengers, as well as your rights to compensation.

Driver Duties After An Accident In Illinois

While practicing defensive driving skills and avoiding illegal driving behaviors such as speeding or driving while intoxicated can help to reduce your risks, you cannot always prevent an accident from occurring. In the event of a crash resulting in property damages or injuries, the Illinois Compiled Statutes require drivers to do the following:

  • Stop immediately at the scene;
  • Report the accident to local or state law enforcement officials;
  • Render aid to any victims;
  • Exchange personal contact information, driver’s license and registration numbers, and insurance information with others involved;
  • File a written report of the accident within ten days to the IDOT.

Failure to do any of the above could result in fines, penalties on your driver’s license, and even criminal charges.

Protecting Your Rights To Compensation

In addition to following all legal requirements in the aftermath of an accident, doing the following can help protect your rights to compensation:

  • Make note of the time and conditions surrounding your accident, and get information from any witnesses at the scene;
  • Taking pictures of the damage to your vehicle, if possible;
  • Get medical care for your injuries, even if they appear minor, and follow all of your doctor’s instructions;
  • Notify your insurer as soon as possible.

When dealing with insurance companies, bear in mind that they have a financial stake in either denying your claim or disputing the amount of damages you have suffered. Before making any statements or signing any documents, speak to one of our experienced attorneys first.
