How Illinois Law Treats Fathers in Child Custody And Parenting Time Matters

Illinois law states very clearly that gender may not be considered in a court’s determination regarding custody or allocation of parental responsibilities and parenting time. The Illinois Family Code states:

Unless the court finds that occurrence of ongoing abuse, the court shall presume that the maximum involvement and cooperation of both parents regarding the physical, mental, moral and emotional well-being of their child is in the child’s best interest. There shall be no presumption in favor of or against joint custody.

Illinois law is also gender-neutral in terms of property division and spousal support. Each party in a divorce is entitled to a just and equitable distribution of marital property, and either party may be awarded spousal maintenance.
