Protecting Children: Success in Hague Convention Case

What is The Hague Convention?

The Hague Convention is a treaty that establishes a process for the return of children who have been wrongfully retained or taken from one country to another. The treaty is designed to protect the rights of children and to prevent them from being used as pawns in international custody disputes. Case Details

In this case, the father had no legal right to take the child from Mexico. He had no court order granting him custody, and he did not seek the mother’s consent. His removal of the child from Mexico was, therefore, a wrongful abduction under the Hague Convention.

Our law firm worked closely with the mother to file a petition with the United States District Court seeking the return of her daughter. We argued that the child was a habitual resident in Mexico and that the father had wrongfully removed her from that country.

The father opposed the petition, but the Judge ultimately ruled in our favor. The Judge found that the child has habitually resided in Mexico and that the father had wrongfully removed her from that country. The Judge ordered the father to comply with the return of the child to Mexico, and the child was safely returned to her mother.
